By accessing and using QuickBizModels (the "Service"), operated by QuickBizModels, a Texas-based business, you accept and agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our Service.

We reserve the right to update these Terms at any time. Continued use of the Service after changes constitutes acceptance of the modified Terms. We encourage you to review these Terms periodically.

2. Eligibility

You must be at least 18 years of age to use this Service. By using the Service, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into these Terms. If you are using the Service on behalf of a business or organization, you represent that you have the authority to bind that entity to these Terms.

3. Description of Service

QuickBizModels provides high-quality financial and business Excel templates for various industries. These digital products are available for purchase and download directly from our website. Our templates are designed to help entrepreneurs, small business owners, and professionals create financial projections and business plans.

4. Digital Products & Licensing

All products available on QuickBizModels are digital downloads. Upon purchase, you are granted a non-exclusive, non-transferable, revocable license to use the templates for your personal or internal business purposes.

You MAY:

  • Use templates for your own business planning and financial projections
  • Modify templates for your specific business needs
  • Use completed financial projections in presentations to banks, investors, or partners
  • Make backup copies for your personal use

You MAY NOT:

  • Resell, redistribute, or sublicense the original template files
  • Share download links or files with third parties
  • Remove any copyright notices or proprietary markings
  • Use templates to create competing products for sale
  • Claim authorship or ownership of the original templates

5. Purchases and Payment

All purchases are processed securely through Stripe. By making a purchase, you agree to provide accurate and complete payment information. You represent that you have the legal right to use any payment method provided.

All prices are listed in U.S. Dollars (USD) and are subject to change without notice. Applicable taxes will be calculated and added at checkout based on your location.

6. Refund Policy

Due to the digital nature of our products and the immediate access provided upon purchase, all sales are generally final. However, we may consider refunds in the following circumstances:

  • Technical issues that prevent the file from opening or functioning properly
  • The product is significantly different from its description
  • Duplicate purchases made in error

Refund requests must be submitted within 14 days of purchase by contacting support@quickbizmodels.com. Refunds are granted at our sole discretion and will be processed to the original payment method within 5-10 business days.

7. User Conduct

When using our Service, you agree NOT to:

  • Use the Service for any unlawful purpose
  • Attempt to gain unauthorized access to our systems or networks
  • Interfere with or disrupt the Service or servers
  • Upload or transmit viruses or malicious code

9. Disclaimer of Warranties

THE SERVICE AND ALL PRODUCTS ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

The templates provided are for educational and informational purposes only. While we strive for accuracy, we do not guarantee that:

  • Templates are free from errors or omissions
  • Financial projections will achieve expected results
  • Templates comply with all accounting standards or regulations
  • Use of templates will secure funding or approval from lenders/investors

You should consult with qualified financial, legal, and accounting professionals before making any business decisions based on these templates.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL QUICKBIZMODELS, ITS DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, SUPPLIERS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION:

  • Loss of profits, revenue, or business
  • Loss of data or information
  • Business interruption
  • Loss of goodwill
  • Any other intangible losses

Our total liability for any claims arising out of or related to these Terms or the Service shall not exceed the amount you paid to us in the twelve (12) months preceding the claim.

11. Indemnification

You agree to indemnify, defend, and hold harmless QuickBizModels and its officers, directors, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising out of or related to:

  • Your use of the Service
  • Your violation of these Terms
  • Your violation of any rights of a third party
  • Any content you submit or transmit through the Service

12. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the State of Texas, United States, without regard to its conflict of law provisions.

Any legal action or proceeding arising out of or related to these Terms or the Service shall be brought exclusively in the state or federal courts located in Texas, and you consent to the personal jurisdiction of such courts.

13. Dispute Resolution

Before filing a claim, you agree to try to resolve any dispute informally by contacting us at support@quickbizmodels.com. We will attempt to resolve the dispute within 30 days.

If informal resolution fails, any dispute shall be resolved through binding arbitration conducted by a single arbitrator in accordance with the rules of the American Arbitration Association. The arbitration shall take place in Texas, and the arbitrator's decision shall be final and binding.

Class Action Waiver: You agree to resolve disputes on an individual basis only and waive the right to participate in any class action or representative proceeding.

14. Privacy

These Terms, together with our Privacy Policy, constitute the entire agreement between you and QuickBizModels regarding the Service and supersede all prior agreements, communications, and understandings, whether written or oral.

18. Waiver

Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision. Any waiver must be in writing and signed by QuickBizModels.
